Paid Onepath products and professional services are governed by a separate written agreement (order form, MSA, or SOW). If those commercial terms conflict with these Site Terms, the commercial terms control for the paid services.
1. Acceptance
By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site. You represent that you are at least 18 years old and, if acting for a company, that you are authorized to bind that company.
2. Informational site; no guarantee of results
The Site provides general information about Onepath’s AI Lead Manager offerings for home service businesses. Content — including ROI calculators, proof statistics, case examples, and product descriptions — is for education and evaluation only. It is not a warranty, guarantee of revenue, booking rate, or uptime, and not an offer to sell unless expressly stated in a signed order. Actual outcomes depend on your lead volume, close rates, staffing, FSM configuration, and other factors outside our control.
3. Discovery calls & inquiries
Submitting a form or scheduling discovery does not create a customer relationship or obligate either party to enter a paid agreement. You agree information you provide is accurate and that you have authority to share business contact details.
4. Acceptable use
You will not:
- Use the Site for unlawful, fraudulent, or harmful purposes.
- Attempt to probe, scrape at abusive rates, disrupt, or reverse engineer the Site.
- Upload malware or content that infringes others’ rights.
- Impersonate Onepath or misrepresent affiliation.
- Submit payment card data through Site forms or email (see Legal Notices / PCI).
5. Intellectual property
The Site, branding, copy, UI, calculators, and trademarks are owned by Onepath or its licensors. You receive a limited, revocable, non-transferable license to view the Site for internal business evaluation. No other license is granted. Competitor names on compare pages are used for nominative fair-use identification only; no affiliation or endorsement is implied.
6. Third-party links & tools
The Site may link to third-party schedulers, FSM vendors, social networks, or other sites. We are not responsible for third-party content, availability, or privacy practices. Use of third-party tools is at your own risk and subject to their terms.
7. AI & automation disclaimers
Descriptions of AI voice, chat, booking, and human CSR overflow describe product capabilities in general terms. AI systems can err; human oversight and your operational policies remain your responsibility when you become a customer under a separate agreement. Do not rely solely on Site demos or marketing copy for safety-critical or emergency dispatch decisions.
8. Text Messaging (SMS) consent — A2P 10DLC
Onepath may send recurring SMS related to discovery scheduling, product updates you request, and account or service notices when you opt in. Message frequency varies. Msg & data rates may apply. Reply STOP to unsubscribe, HELP for help. Consent is not a condition of purchase.
Opt-in requires an affirmative, unchecked SMS consent control when you submit a phone number on this Site. Full program details, including STOP/HELP and carrier notes, are in the Terms of Service. Mobile opt-in information is not shared with third parties or affiliates for marketing purposes (see our Privacy Policy).
9. No professional advice
Nothing on the Site is legal, accounting, tax, or regulated telecommunications advice. Consult your own advisors before changing answering services, call recording, or TCPA / consent practices for outbound messaging.
10. Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Onepath AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE — WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). You agree to defend and indemnify Onepath against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights.
13. Governing law & venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for disputes arising from the Site lies in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
14. Changes & termination
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance. We may suspend or terminate Site access for any reason, including suspected abuse.
